BoomCast Terms of Service

These Terms are an agreement between you and Solva Labs LLC covering your use of the BoomCast app and related services (together, “BoomCast”). By creating an account or using BoomCast, you agree to them.

1. Who can use BoomCast

You must be at least 13 years old. If you’re under 18, you need a parent or guardian’s permission. You’re responsible for your account and for keeping your sign-in method secure.

2. Your license to use BoomCast

We grant you a personal, non-exclusive, non-transferable, revocable license to use BoomCast for creating and sharing videos. You may not copy, modify, reverse-engineer, scrape, resell, or interfere with the service, or use it to build a competing dataset or product.

3. Credits & subscriptions

Credits are a consumable in-app item. They unlock video generation, have no cash value, are non-transferable and non-refundable except where the law requires, and are forfeited if your account is deleted or terminated for breach.
Purchases run through Apple. Prices are shown before you buy. Subscriptions renew automatically until cancelled in your App Store settings at least 24 hours before the period ends. Refunds are handled by Apple under their terms.
Earned credits (referrals, remix royalties, promotions) are bonuses we may grant, adjust, or discontinue; abusing reward systems (fake accounts, self-referrals) forfeits them.
If a generation fails on our side, the credits are automatically returned.

4. Your content

You own what you make. Your uploads and the videos you generate are yours, subject to the licenses below and to the rights of others.
License to us. You grant Solva Labs a worldwide, royalty-free license to host, store, process, reproduce, and display your content for the purpose of operating and improving BoomCast — including sending your prompts and uploads to our AI processing partners to fulfill your generation requests. For content you publish publicly, this includes displaying it on community feeds and profiles. This license ends when you delete the content or your account, except for copies in routine backups and content other users have already remixed.
Remixing. If you publish a video with remixing enabled, you grant other BoomCast users a license to reuse that video’s style recipe (its settings, cast, and structure — never your private uploads) to create their own videos. In return you earn credit royalties as described in the app. Remixes of your video don’t transfer ownership of your original.
Your responsibility. Only upload material you have the right to use. Don’t impersonate people or brands, and don’t use others’ trademarks, likenesses, or copyrighted work without permission.

5. AI-generated content

BoomCast uses third-party AI models. Generated content may be inaccurate, unexpected, or similar to other generated content, and we make no promise of uniqueness or fitness for a particular purpose. Review your videos before you use them — especially claims in ads. You’re responsible for how you use generated content, including complying with advertising, disclosure, and AI-labeling laws that apply to you.

6. Community rules & moderation

Our Community Guidelines are part of these Terms. We may remove content, restrict features, or suspend or terminate accounts that violate them — with or without notice, depending on severity. You can report content from the ⋯ menu on any video and block any creator.

7. Copyright complaints

If you believe content on BoomCast infringes your copyright, email hi@boomcast.app with (a) the content’s link or location, (b) the work it infringes, (c) your contact details, and (d) a statement, under penalty of perjury, that you’re authorized to act. We remove infringing content and terminate repeat infringers.

8. Termination

You can stop using BoomCast at any time and delete your account in Settings. We may suspend or terminate accounts that breach these Terms, abuse reward systems, or create risk for us or other users. Sections 4–12 survive termination.

9. Disclaimers

BoomCast is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that the service will be uninterrupted, error-free, or that generated content will meet your requirements.

10. Limitation of liability

To the fullest extent the law allows, Solva Labs will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, data, or goodwill. Our total liability for all claims relating to BoomCast is limited to the greater of US $100 or the amount you paid us in the 12 months before the claim. Some jurisdictions don’t allow these limits, so they may not fully apply to you.

11. Indemnity

You’ll indemnify Solva Labs against claims arising from your content, your use of BoomCast, or your breach of these Terms.

12. Apple App Store terms

These Terms are between you and Solva Labs, not Apple. Apple has no obligation to provide support or maintenance for BoomCast and isn’t responsible for any product claims, IP claims, or legal compliance relating to the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Where our terms are silent, Apple’s standard Licensed Application End User License Agreement applies.

13. Changes & governing law

We may update these Terms; material changes will be announced in the app or by email, and continued use means acceptance. These Terms are governed by the laws of the United States and the state in which Solva Labs LLC is organized, without regard to conflict-of-law rules. If any provision is unenforceable, the rest remain in effect.
